These terms apply when you use eliyasianiart.com or buy from it. The site is run by Eliya Siani ("I", "me"), an independent artist based in the United States. By placing an order you agree to these terms, the shipping policy, the refund policy and the privacy policy.
The artwork
- Original paintings are one of a kind and painted by hand. The size and medium are listed on each painting's page. Brush marks, texture and small irregularities are part of the work, not flaws.
- Canvas prints are printed to order on canvas stretched over 1.5-inch-deep bars, with mirrored edges. Framed prints come in a 1.5-inch floating frame with a hanging wire; unframed prints come with a sawtooth hanger.
- Colors on screens vary, and a print never looks exactly like the painted original. Room views and frame previews on the site show size and style; they are illustrations, not photos of your exact print.
Prices and availability
Prices are in US dollars. Shipping and any sales tax are shown before you pay. Because each original exists only once, it can sell to someone else, or be reserved in another checkout, while you are looking at it. If an original sells before your payment completes, or if a price on the site is clearly wrong, I'll cancel the order and refund you in full.
Orders and payment
Payment is taken by PayPal (PayPal, Venmo or debit or credit card). Your order is confirmed when the payment is completed and you see your order number (for example ES-1003). I may cancel and refund an order in rare cases, for example suspected fraud or an item I can't supply; you'll always get an email explaining why.
Copyright
All paintings, photos and text on this site are © Eliya Siani. Buying an original painting or a print gives you ownership of that physical object. It does not transfer the copyright or the right to reproduce the image. You may not copy, print, sell or use the images commercially (including for AI training) without my written permission. Sharing photos of your painting or print on social media is welcome; please credit @eliyasianiart.
Commissions
The price, size, timeline, deposit and approval steps of a commission are agreed in writing before I start. By sending reference photos, you confirm you have the right to use them for the painting. I may show a finished commission in my portfolio and on social media unless we agree otherwise.
Using the site
Please don't misuse the site: no attempts to break its security, scrape it in bulk, or send spam through its forms.
Liability
I take care to describe every piece accurately and to ship it safely. To the extent the law allows, my total liability for any order is limited to the amount you paid for it. Nothing in these terms limits rights you have under consumer law.
Governing law
These terms are governed by the laws of the State of New York, USA.
Changes
I may update these terms from time to time; the version posted when you order applies to that order.
